Los extranjeros indeseables serán deportados de Rusia sin juicio

January 29, 2013 in Russia, the order of Interior Minister Vladimir Kolokoltsev enter into force, it will change the rules of the expulsion of undesirable persons, citizens of other countries, from Russia.

The power – wielding structures will initiate the deportation and the Russian Interior Minister or his deputy will authorize it, – informs the newspaper “RBC daily”.

According to the Federal Migration Service, the order was signed to simplify the difficult bureaucratic procedure that makes the process of expulsion of undesirable foreigners very difficult and it requires judicial decision.

Now, for the territorial authorities it will be enough to prepare for such a person a set of documents and send it to the Interior Ministry, where within fourteen days the documents will be reviewed and signed, if approved. After receiving notice of such decision, the foreigner will have from a few days to a month to leave the country.

The innovation concerns not only the illegal immigrants, but also the foreigners living in Russia legally in cases where their stay in the country “poses a real threat to the defense or security of the State, public order, or public health”.

FMS maintains that the order aims “not at the forced expulsion of someone according to the police request, but at some individuals who may be informed that their stay on the territory of our country is undesirable”. However, some experts believe that because of the lack of the list of documents that are required to expel a foreigner from Russia, the foreigner will have grounds to file a lawsuit to challenge the decision.
