Procedure of obtaining a work visa for Highly Qualified Specialist
Obtaining a work visa for Highly Qualified Specialist is a multi-step and a very long process, but it is much easier and quicker than getting a regular Work visa.
For example, to legally hire a foreigner with work visa a company-employer registered in Moscow will require on average 80 days and 9500 rubles only for state fees. And to get a work permit and visa for Highly Qualified Specialist it is required 16 working days and 2500 rubles for the state fee for issuing Visa Invitation in FMS, plus the usual time and the consular fee for issuing the visa at the Russian consulate.
Besides Work visa is given for one year maximum and it is necessary to start the process of prolongation of this visa already in 6 months after getting the current visa, but the visa for Highly Qualified Specialist is issued for up to three years and it is possible to extend it for another 3 years over 30 days before expiry of current visa.
Visas for Highly Qualified Specialist are issued by FMS of Russia
CIS citizens do not require visas to enter Russia, and the Work permit for Highly Qualified Specialist is issued in common order for all foreigners.
Steps of the process to obtain a visa for Highly Qualified Specialist:
- Work permit (Plastic card) for a foreign citizen in FMS of Russia.
- A working visa invitation for a foreigner (not required if the foreigner is already in Russia at the invitation of company-employer).
- Obtaining of TIN for Highly Qualified Specialist in the Federal Tax Service and the notification of reception of TIN to FMS of Russia.
- Quarterly notification to FMS of Russia about the amount of salary received by Highly Qualified Specialist.
To obtain a Work permit for Highly Qualified Specialist a company-employer must submit to the FMS of Russia:
- application for hiring a Highly Qualified Specialist;
- employment contract with hired Highly Qualified Specialist, that enter into force due to the reception of work permit by this Highly Qualified Specialist. A prerequisite for acceptance of an employment contract is the following data:
- date of the employment contract;
- position of hired Highly Qualified Specialist;
- salary in rubles;
- information on provided health insurance.
- written obligation to pay the costs of Russian Federation related to possible deportation from Russian Federation of employed Highly Qualified Specialist;
- TIN, KPP code and a copy of the certificate of state registration of legal entities or extract from the register of branches of foreign legal entities accredited in accordance with established procedure in Russian Federation, in case if a company-employer is a branch of a foreign legal entity;
- receipt of payment of state fee at a rate of 2000 rubles per person;
- colored photo of Highly Qualified Specialist(3×4 cm) on the mat paper;
- copy of passport of Highly Qualified Specialist, translated into Russian and notarized.
Term of consideration of the employer's application on attraction of Highly Qualified Specialist is 16 working days from the date of application.
